Welcome to Rally!

Rally Charlotte, LLC ("Rally," "we," "us," or "our") operates websites, digital platforms, and online services that connect guests with Rally’s pickleball facilities, programs, events, and experiences.

These Website Terms of Service ("Terms") govern your access to and use of Rally’s websites, online services, digital features, and other services that link to these Terms (collectively, the "Services"), including:

Please read these Terms carefully before accessing or using the Services.

By accessing or using the Services, creating an account, making a reservation, purchasing products, registering for programs or events, submitting information, or otherwise interacting with Rally online, you acknowledge that you have read, understood, and agree to be bound by these Terms and Rally’s Privacy Policy.

If you do not agree to these Terms, you may not access or use the Services.

1. About Rally Services

Rally provides pickleball, hospitality, entertainment, and community experiences, including:

  • Court reservations;

  • Open play;

  • Leagues;

  • Tournaments;

  • Clinics;

  • Lessons;

  • Camps;

  • Membership programs;

  • Private events and group experiences;

  • Food and beverage offerings;

  • Merchandise; and

  • Other products, programs, and services offered by Rally.

Rally may update, modify, suspend, or discontinue portions of the Services at any time.

Certain Rally services may be subject to additional terms, policies, waivers, releases, or requirements provided at the time of registration, reservation, purchase, or participation.

2. Website and Booking Platform

Rally's primary website is located at:

www.rallypickleball.com

The Website provides information about Rally locations, programming, events, memberships, promotions, merchandise, careers, and other Rally offerings.

Court reservations, memberships, event registrations, and certain other transactions are completed through Rally’s booking platform:

book.rallypickleball.com

The Booking Platform is powered by a third-party reservation technology provider and may be subject to additional terms, policies, and requirements presented during account creation, checkout, registration, or participation.

These additional policies may include:

  • Reservation requirements;

  • Cancellation policies;

  • Membership terms;

  • Payment terms;

  • Participation requirements; and

  • Facility rules.

By using the Booking Platform, you agree that these Terms govern your relationship with Rally, while service-specific terms presented during booking govern the applicable reservation, purchase, or registration.

Food and beverage services provided at Rally locations may be governed by Rally’s separate Food Service Terms of Service.

3. Accounts and User Information

Certain Rally services may require you to create an account.

When creating an account or providing information to Rally, you agree that:

  • Information you provide is accurate and complete;

  • You will update information as needed;

  • You are responsible for maintaining the confidentiality of your account information;

  • You are responsible for activity associated with your account; and

  • You will notify Rally of unauthorized account access.

You may not:

  • Create an account using false information;

  • Impersonate another person;

  • Use another person's account without permission; or

  • Use the Services for fraudulent or unlawful purposes.

Rally reserves the right to suspend or terminate accounts that violate these Terms or create risk to Rally, its guests, employees, or partners.

4. Reservations, Memberships, Purchases, and Programs

Reservations, memberships, event registrations, merchandise purchases, and other transactions may be completed through Rally’s Website, Booking Platform, or other authorized channels.

By completing a reservation, membership enrollment, registration, or purchase, you agree to:

  • Provide accurate information;

  • Pay all applicable fees and charges;

  • Follow applicable cancellation and refund policies;

  • Comply with Rally’s facility rules and requirements; and

  • Complete any required waivers or releases.

Rally memberships may require recurring payments. Membership pricing, billing frequency, cancellation requirements, and other membership terms will be provided at the time of enrollment.

Rally reserves the right to modify, reschedule, or cancel programs, events, reservations, or activities when necessary, including due to weather, safety concerns, facility conditions, staffing, or other circumstances.

5. SMS/Text Messaging

By providing your mobile phone number and opting in to receive text messages from Rally, you consent to receive recurring SMS and MMS messages from Rally, including transactional, operational, and marketing communications.

Messages may include:

Transactional and operational messages:

  • Court reservation confirmations and reminders;

  • Court readiness notifications;

  • Waitlist notifications;

  • Event, league, tournament, and clinic updates;

  • Membership and account notifications; and

  • Customer service communications.

Marketing messages:

  • Promotions and special offers;

  • New programming announcements;

  • Community updates; and

  • Other promotional communications.

Message frequency varies based on your interactions with Rally.

Message and data rates may apply according to your wireless carrier plan.

Consent to receive marketing text messages is not a condition of purchasing any goods or services.

You may opt out of marketing text messages at any time by replying STOP to any message. After opting out, you may receive one final confirmation message. You will no longer receive marketing text messages unless you opt in again.

Wireless carriers are not responsible for delayed or undelivered messages.

Your use of Rally’s SMS services is also subject to Rally’s Privacy Policy.

6. Email and Electronic Communications

By providing your email address or otherwise communicating electronically with Rally, you consent to receive electronic communications from Rally.

These communications may include:

  • Reservation information;

  • Event updates;

  • Account communications;

  • Customer service responses;

  • Newsletters;

  • Promotions; and

  • Other service-related communications.

You may unsubscribe from marketing emails by following the unsubscribe instructions included in those communications.

Rally may continue sending non-promotional communications related to your account, reservations, purchases, or requests.

7. User Submissions and Reviews

The Services may allow you to submit information through contact forms, inquiries, surveys, applications, reviews, testimonials, or other features ("Submissions").

By submitting information to Rally, you represent that:

  • The information provided is accurate;

  • You have the right to provide the information; and

  • The submission does not violate applicable law or third-party rights.

Rally may use Submissions to respond to inquiries, provide services, improve operations, and for other purposes consistent with Rally’s Privacy Policy.

If you submit reviews, testimonials, photographs, comments, or other content, Rally may use that content for business purposes, including marketing and promotional purposes, consistent with applicable law and Rally’s Privacy Policy.

You should not submit sensitive personal information through general Website forms, including payment card numbers, government identification numbers, or other confidential information.

8. Intellectual Property

The Services and all related content, including text, graphics, logos, trademarks, images, videos, software, technology, designs, digital experiences, and other materials (collectively, "Content") are owned by Rally or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Rally’s intellectual property includes, without limitation, its:

  • Name and branding;

  • Logos and trademarks;

  • Website content;

  • Photography and creative assets;

  • Software and technology;

  • Digital systems and experiences.

You may not:

  • Copy, modify, reproduce, distribute, sell, or create derivative works from Rally Content;

  • Use Rally trademarks, logos, or branding without permission;

  • Reverse engineer or attempt to extract source code from Rally technology; or

  • Use Rally Content for commercial purposes without prior written authorization.

9. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation;

  • Interfere with the operation or security of the Services;

  • Attempt unauthorized access to Rally systems;

  • Use automated tools to scrape or collect information without permission;

  • Upload malicious code or harmful materials;

  • Submit false or fraudulent information; or

  • Harm Rally, its guests, employees, partners, or vendors.

Rally may restrict or terminate access to the Services for violations of these Terms.

10. Third-Party Links and Services

The Services may contain links to third-party websites, platforms, applications, or services.

These may include:

  • Booking platforms;

  • Payment processors;

  • Social media platforms;

  • Marketing platforms; and

  • Partner websites.

Third-party services are governed by their own terms and privacy policies.

Rally does not control and is not responsible for third-party services, including their availability, content, security, or privacy practices.

11. Privacy

Your use of the Services is also governed by Rally’s Privacy Policy, which explains how Rally collects, uses, stores, and shares Personal Information.

The Privacy Policy is incorporated into these Terms by reference.

12. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, RALLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT.

RALLY DOES NOT GUARANTEE THAT:

  • THE SERVICES WILL ALWAYS BE AVAILABLE;

  • THE SERVICES WILL BE ERROR-FREE;

  • INFORMATION PROVIDED THROUGH THE SERVICES WILL ALWAYS BE COMPLETE OR CURRENT; OR

  • THE SERVICES WILL BE FREE FROM HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RALLY CHARLOTTE, LLC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RALLY'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

14. Indemnification

You agree to defend, indemnify, and hold harmless Rally Charlotte, LLC and its officers, employees, contractors, affiliates, partners, and service providers from claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services;

  • Your violation of these Terms;

  • Your violation of applicable law; or

  • Your violation of another person's rights.

Rally reserves the right to assume control of the defense of any matter subject to indemnification.

15. Changes to These Terms

Rally may update these Terms from time to time.

Updated Terms will be posted on the Services with a revised "Last Updated" date.

Your continued use of the Services after changes become effective means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or your use of the Services shall be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina.

17. General Terms

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Rally’s failure to enforce any provision of these Terms does not waive its right to enforce that provision in the future.

These Terms, together with Rally’s Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and Rally regarding your use of the Services.
